1. Acknowledgement

You and the Company acknowledge that this Agreement is concluded between you and the Company only, and not with Apple Inc. ("Apple") or Google LLC ("Google"). The Company, not Apple or Google, is solely responsible for the App and the content thereof.

2. License

The Company grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App solely for your personal, non-commercial purposes strictly in accordance with the terms of this Agreement.

This license automatically terminates if you breach the applicable Terms of Service.

Feature availability in the App may depend on your active subscription entitlement and valid third-party banking consent. If entitlement is no longer active, certain bank-connected features may be limited or disconnected until renewed consent is completed.

• iOS Users: This license is limited to use on Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
• Android Users: This license is subject to the Google Play Terms of Service.

3. Maintenance and Support

The Company is solely responsible for providing any maintenance and support services with respect to the App. You and the Company acknowledge that neither Apple nor Google has any obligation whatsoever to furnish any maintenance and support services with respect to the App.

4. Warranty

The App is provided "AS IS" without warranty of any kind. To the maximum extent permitted by applicable law, the Company disclaims all warranties.

• iOS Users: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if applicable). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
• Android Users: Google is not responsible for any product warranties, whether express or implied by law.

5. Product Claims

You and the Company acknowledge that the Company, not Apple or Google, is responsible for addressing any claims of you or any third party relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

6. Intellectual Property Rights

You and the Company acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, the Company, not Apple or Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim. EKO is a registered trademark of LDev AB, registered with the European Union Intellectual Property Office (EUIPO).

7. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

8. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the App (e.g., you must not be in violation of your wireless data service agreement when using the App).

9. Third-Party Beneficiary

You and the Company acknowledge and agree that Apple (and Apple’s subsidiaries) and Google (and Google’s subsidiaries) are third-party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, they will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions.
